Marilyn Buttaccio

Marilyn heads Young & Young’s estate planning & estate administration team and has worked at Young & Young for more than 20 years. She has extensive experience in all aspects of estate and succession planning, administration and estate litigation. Marilyn is also very experienced in personal injury actions, including motor vehicle accident claims and workers compensation.

Marilyn graduated from Murdoch University with a Bachelor of Laws in 1993 and was admitted to practice as a Barrister and Solicitor of the Supreme Court of WA in 1995. Originally from the South West farming area, it was always Marilyn’s intention to return to practice law in the South West.  In addition to her practice in Bunbury, Marilyn has been the face of Young & Young’s Collie office for many years. Marilyn prides herself on delivering quality advice and assistance to clients, having practised in a broad range of areas of law including conveyancing, criminal law, criminal injuries compensation, workers' compensation, personal injuries, Fatal Accident Act claims, civil litigation and succession planning.

Areas of Practice

  • Wills and estate matters, including Testamentary Trusts

  • Estate planning including Enduring Powers of Attorney, Enduring Powers of Guardianship, Superannuation Funds and Family Trust deeds

  • Supreme Court applications for Grants of Probate and Letters of Administration (where there is no will) and Applications for proof of informal wills

  • General administration & winding up of estate matters

  • Representing parties applying for or defending an application for a Guardianship or Administration Order in the State Administrative Tribunal

  • Disputed Estate matters, including acting as both Counsel and instructing solicitor in Supreme Court Inheritance actions under the Family Provisions Act.

  • Personal injury actions, including motor vehicle claims, public liability actions, workers’ compensation claims and Fatal Accident Act claims, requiring representation of parties in the Magistrates Court, District Court of WA and Workcover

  • Conveyancing, including attending to transfer and transmission of properties and assets, including Deeds of Transfer and Family Arrangement for farming families and businesses and liaising with accountants and financial advisers.
